Propiedad Intelectual y Protección de la Plataforma

1. Ownership

PrediSmart and its licensors retain all intellectual property and proprietary rights in the Platform and protected related materials. Customer ownership of Customer Data does not transfer ownership of the Platform or PrediSmart technology.

2. Reserved Rights

No right is granted by implication, estoppel, access, disclosure, evaluation, subscription, or technical interoperability except the limited rights expressly granted in the governing agreement.

3. Prohibited Exploitation

Unauthorized reproduction, copying, adaptation, distribution, commercialization, sublicensing, extraction, harvesting, competitive exploitation, derivation, or use of protected Platform materials outside the authorized purpose is prohibited.

4. Reverse Engineering and Technical Analysis

Reverse engineering, decompilation, disassembly, circumvention, source-code discovery, technical extraction, or equivalent activity is prohibited to the maximum extent permitted by applicable law. Where applicable law grants a mandatory interoperability, observation, study, testing, backup, or similar right that cannot be contractually waived, the restriction applies only to the lawful maximum and the resulting information may not be used beyond the legally protected purpose.

5. Security and Access Controls

Circumvention or interference with access controls, tenant boundaries, authentication, integrity mechanisms, security controls, rate limits, or other protective measures is prohibited.

6. Competitive and Automated Use

Protected Platform materials, non-public functionality, documentation, interfaces, outputs, or datasets may not be systematically collected or used to create, train, benchmark, reproduce, or materially facilitate a competing product or service except where PrediSmart expressly authorizes the activity or applicable law requires otherwise.

7. Feedback

Unless otherwise agreed in writing, voluntary feedback may be used by PrediSmart without restriction or obligation, provided it does not transfer Customer ownership of Customer Data or confidential information.

8. Marks

PrediSmart names, logos, product identifiers and related marks may be used only as authorized. White-label rights, if purchased, do not transfer ownership of PrediSmart underlying technology.

9. Protection and Remedies

PrediSmart may use contractual, technical and legal measures to protect its intellectual property, confidential information, systems and rights. Nothing in this Policy limits remedies available under applicable law.
